OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards. (a) Shop Assembly: On or about October 7, 2012, and at times prior thereto, an employee was exposed to a fall hazard while climbing in/out of a manufactured home wearing stilts. Note: Abatement certification IS required for this item.

29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level was not guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. (a) Floor Build Area: On or about October 17, 2012, fabrication and assembly of manufactured homes where employees are working approximately 16 feet above a concrete floor without fall protection. Note: Abatement certification IS required for this item.
