On or about November 11, 2012, at the above addressed jobsite, safety inspections had not been made by persons capable of identifying and correcting hazards so as to assure compliance with the company's safety program.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure: a. On or about November 5, 2012, at the above addressed jobsite, employees working from the 10/12 pitched roof of the three story townhouse were exposed to falls of approximately 30 feet due to the lack of a fall protection system. APEK INCORPORATED WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 391143, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS FINAL ORDER ON AUGUST 31, 2012 WITH RESPECT TO A WORKPLACE LOCATED AT 9531 W. GOLFVIEW DRIVE IN FRANKFORT, IL.
