On or about November 8, 2012, the rungs of the fixed ladder of the Spec Mix silo were not uniformly spaced and level when workers used it to access the top of the silo.

On or about November 8, 2012, the fixed ladder of the Spec Mix silo was damaged and employees of the subcontractor continued to use the ladder to access the silo.

29 CFR 1910.1200(e)(2)(i): The employer did not ensure that the hazard communication program implemented the methods the employer will use to provide the other employers on-site access to safety data sheets for each hazardous chemical the other employers' employees may be exposed to while working (Construction Reference 1926.59): a) Butterfield Hall construction and renovation site in Edinboro, PA. On or about November 8, 2012, on the multi-employer worksite, the general contractor, Vendrick Construction Incorporated, did not have Safety Data Sheets available or readily accessible to provide to other employers whose employees may be exposed to the hazardous chemicals created by the work of the masonry subcontractor. The general contractor did not put into practice the methods developed to provide safety data sheets to each prime or subcontractor working at the jobsite.
