29 CFR 1926.1101(f)(3)(i): The employer failed to conduct daily monitoring that was representative of the exposure of each employee assigned to work in regulated areas and performing Class I or II work. On or about October 1, 2012 and during the duration of the job, the employer failed to monitor for asbestos during work done on the removal of transite panels containing chrysotile asbestos from the Old CBU roof at the AMVAC Chemical Companys facility after it became evident that some of the tiles were breaking.

29 CFR 1926.1101(f)(2)(i): The employer failed to ensure that the exposure assessment was conducted in time to comply with requirements which are triggered by the exposure data or the lack of a negative exposure assessment: On or about October 1, 2012 the employer failed to do initial monitoring for asbestos before work began on the removal of transite panels containing chrysotile asbestos from the Old CBU roof at the AMVAC Chemical Companys facility.
