29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level. Worksites, rooftop - Employees, engaged in masonry work on the chimney of a residential home, were observed working from a scaffold system on the roof. The roof edge was approximately 20 feet above the ground. No guardrail systems, end rail systems or personal fall arrest systems were in place for work on a scaffold; on, or about, 10/23/12. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. Worksite, rooftop - Employees engaged in masonry work on the chimney of a residential home, were observed working from a scaffold system on the roof. The roof edge was approximately 20 feet above the ground. Fall protection systems were not in place; on, or about, 10/23/12. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
