29 CFR 1926.1053(b)(1):  Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.    The employer does not extend the portable ladder three feet above the upper landing surface to which the ladder is used to gain access.  This violation was observed on or about November 7, 2012, at the job site where employees were exposed to a fall hazard climbing onto the roof of a residential structure from an extension ladder that was only extended 1.5 feet.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all ladders are used properly.

29 CFR 1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).    The employer does not protect employees from falling when working 6 feet or more above lower levels.  This violation was observed on or about November 7, 2012, at the job site where employees were exposed to a fall hazard when performing roofing activities on a residential structure without a fall protection system.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from falls.
