29 CFR 1926.102(a)(1): Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents. a) On 11/08/2012, on the north end of the construction site, the employer allowed an employee to use a Ryobi circular saw to cut wood boards without wearing eye protection. b) On 11/08/2012, on the southwest and southeast corners of the construction site, the employer allowed employees to operate nail guns without wearing eye protection.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about 11/08/2012, on the southeast and southwest corners of the building being constructed, the employer allowed the employees to work at an elevation of 12 feet above a concrete surface without fall protection while one employee operated a nail gun (southwest corner) and the other employee helped position plywood (southeast corner).
