29 CFR 1910.134(c)(1): The employer did not ensure that a written respiratory protection program with worksite-specific procedures was established and implemented to include the provisions of (i)-(ix), as required by both 29 CFR 1926.103 and 29 CFR 1910.134: a) The employer does not ensure that a written respiratory protection program with worksite-specific procedures was established and implemented. This violation occurred on or about November 8, 2011 when employees were required to wear N-95 filtering facepiece respirators while sanding on painted wood trim at the Dillard University Straight Hall renovation site.

29 CFR 1926.404(b)(1)(iii)(C): The employer did not ensure that each cord set, attachment cap, plug and receptacle of cord sets, and any equipment connected by cord and plug, except cord sets and receptacles which are fixed and not exposed to damage, were not visually inspected before each day's use for external defects, such as deformed or missing pins or insulation damage, and for indications of possible internal damage: a) The employer does not ensure that flexible cord sets are inspected for damage and, if damaged, removed from service. This violation occurred on or about November 8, 2012, on the first floor of the Dillard University Straight Hall renovation, where employees were using a Dewalt 130 (SN: 254140) drill motor with a mixing paddle connected to a fourteen (14) gauge flexible cord set that exhibited signes of internal damage from overcurrent conditions.
