Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized struck-by hazards that were causing or likely to cause death or serious physical harm to his employees. Among other methods, feasible and acceptable means of abatement, this hazard includes but is not limited to: (1) Require employees wear high visibility apparel to make them more visible to vehicle and equipment operators. Pursuant to 29 CFR 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to protect employees from being struck-by construction vehicles and equipment.    This violation occurred on September 11. 2012, at a workplace located at the Caddo Lake National Wildlife Refuse, Karnack, Texas 75661; where employees, on foot, were not protected from being struck-by construction vehicles and equipment.

Pursuant to 29 CFR 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to train employees in the recognition and avoidance for fall and struck-by hazards.    This violation was discovered on November 7, 2012, at a workplace located in the Caddo Lake National Wildlife Refuge, Karnack, Texas 75661; where the employer did not  instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate fall and struck-by hazards.

The employer does not ensure employees are protected from head injuries due to impact or falling or flying objects.  Pursuant to 29 CFR 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to protect employees when working in areas where there is a possible danger of head injuries.      This violation occurred on September 11, 2012, at a workplace located in the Caddo Lake National Wildlife Refuge, Karnack, Texas 75661; where employees were not protected from head injuries from flying rock and debris by wearing hard hats.
