29 CFR 1926.20(b)(2):  The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):    a)	Dana McBride Homes at 363 Osiander St., Fort Collins, CO 80524:  On and before November 7, 2012, the controlling employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person.  Four subcontractor employees were working next to the edge of the 2nd level subfloor and next to the stairwell opening on both levels of three residential homes without the use of a fall protection system. The subcontractor employees were framing floors and walls of the home. These conditions exposed employees to fall hazards of approximately 8.6 to18.5 feet to the level below.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided:    (a)	Dana McBride Homes at 363 Osiander St., Fort Collins, CO 80524:  On and before November 7, 2012, as the controlling employer, did not ensure the employees were protected from injury, in that employees engaged in construction activities on the 2nd level of a residential home had exposure to a fall hazard from an unprotected floor opening (stairwell opening) that lead into the basement.  This condition exposed the employees to a fall hazard of approximately 18.5 feet.    (b)	Dana McBride Homes at 363 Osiander St., Fort Collins, CO 80524:  On and before November 7, 2012, as the controlling employer, did not ensure the employees were protected from injury, in that employees engaged in construction activities on the 2nd level of a residential home had exposure to a fall hazard from unprotected sides and edges.  This condition exposed the employees to a fall hazard of 11.5 feet.    (c)	Dana McBride Homes at 357 and 369 Osiander St., Fort Collins, CO 80524:  On and before November 7, 2012, as the controlling employer, did not ensure the employees were protected from injury, in that employees engaged in construction activities on the 2nd level of a residential home had exposure to a fall hazard from unprotected wall openings (window openings).  This condition exposed the employees to a fall hazard of approximately 11.5 feet.
