29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:(a)(LOCATION)(IDENTIFY SPECIFIC CHEMICAL/PRODUCT(S) EXPOSURE INCLUDING SPECIFIC TARGET ORGAN EFFECTS, CARCINOGEN WARNING AND/OR PHYSICAL HAZARDS AS APPLICABLE WHICH ARE NOT LISTED ON THE LABEL)    (a) At 147 Nimitz Drive, Piti, GU (Nimitz Towers, Unit A-45), on or about November 9, 2012 and at times prior thereto, there was no written hazard communication program when an employee used Vista Carefree 8300 Eggshell Finish paint.

29 CFR 1910.1200(g)(8):  The employer did not ensure that material safety data sheets were readily accessible to the employees in their work area during each work shift:    (a) At Nimitz Towers, Unit A-45, on or about November 9, 2012 and at times prior thereto, there was no material safety data sheets for Vista Carefree 8300 Eggshell Finish paint.  Employee applied the paint onto the apartment walls using a roller and brush.
