29 CFR 1910.23(d)(1)(iv): On stairways more than 44 inches wide but less than 88 inches wide, one handrail on each enclosed side and one stair railing on each open side. a) At West Side of Building: On or about November 8, 2012 and at times prior; the employer exposed his employes to fall hazards in that he failed to ensure the stairway had a midrail installed on the open side. b) At East Side of Building: On or about November 8, 2012 and at times prior; the employer exposed his employes to fall hazards in that he failed to ensure the stairway had a midrail installed on the open side.

29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides: a) At West Side of Building: On or about November 8, 2012 and at times prior; the employer exposed his employees to fail hazards in that he did not ensure a platform used by employees for break purposes has mid-rails installed exposing employees to falls of 6 feet to the ground below. b) At East Side of Building: On or about November 8, 2012 and at times prior; the employer exposed his employees to fail hazards in that he did not ensure platform at the top of the stairway used by employees had mid-rails installed exposing employees to falls of 4 feet 10 inches to the ground below.
