On or about November 8, 2012, at the above addressed jobsite, a safety and health program, which would address those hazards associated with the employees' work environment and the company's procedures to eliminate those hazards, had not been developed and maintained.

29 CFR 1926.501(b)(11):  Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:    a. On or about November 8, 2012, at the above addressed jobsite, employees working on the 5/12 pitched roof of the apartment building were exposed to falls of approximately 20 feet due to the lack of fall protection.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:    a. On or about November 8,2012, at the above addressed jobsite, an employee training program addressing the fall hazards associated with roofing work and the company's procedures to be followed to protect the employees from exposure to those hazards had not been developed and maintained.
