29 CFR 1926.652(g)(1)(iii): Employees were not protected from the hazard of cave-ins when entering or exiting the area protected by shields: (a) Jobsite, Route 148, McKeesport, PA: On or about 11/09/12 employees were not protected from the hazard of cave-ins when entering or exiting the areas protected by shields. Employees exited from a manhole box where approximately 8 feet of side walls were unprotected and climbed up the sloped side wall to exit to the upper ground level. No protection(s) was in place to protect the employees from potential cave-ins.

29 CFR 1926.652(g)(2): Excavations of earth material to a level no greater than 2 feet (.61m) below the bottom of a shield was permitted: (a) Jobsite, Route 148, McKeesport, PA: On or about 11/09/12 the knife edge of the 8' x 24' shield, at the northwest end, was approximately 6 feet above the bottom of the excavation exposing employees working in the protective system to potential cave-in hazards.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. (a) Jobsite, Route 148, McKeesport, PA: On or about 11/09/12 the competent person on site failed to remove employees where evidence showed the protective system was not installed properly exposing employees to potential cave-ins. The 8' x 24' protective shield had the northwest end installed approximately six feet above the bottom of the excavation exposing the employee(s) working in this area to potential cave-in.
