29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:Note:  Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard.    (a) The Plastic Sort Line:  Employees were exposed to the level above the Plastic Sort Line which did not have a top rail and midrail and was 13 feet above the ground floor.    (b) Platform to Entrance Door to Warehouse: The concrete platform by the outside entry door to the Warehouse building did not have a toprail and midrail, and was over four feet above the ground.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:    (a) Employees were being required to wear 3M 8247, and/or 3M 8210 N195 Particulate respirators when entering the pit area under the Cardboard Baler in the Tipping Area/Warehouse and there was no written respiratory protection program. The plastic bales were stacked 4 high and on a slope.  The plastic bales were not stable as an accident occurred on or about November 6, 2012 where two or more plastic bales fell over crushing a temporary service employee.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    (a) Employees were exposed to hazardous chemicals, such as, but not limited to, Hydraulic fluid, and Shell Rotella T Triple Protection Motor Oil, diesel fuel, and there was no written hazard communication program specifying labelling and other forms of warning for chemicals, how material safety data sheets are to be maintained in the workplace, and how employees will be given information and training.  The hazard communication program was being kept in the other site location in Fordland, Missouri.  Chemicals, such as, but not limited to, the motor oil has been in a Hiland Dairy milk jug, which did not have the identity, and hazard warning on the bottle.
