29 CFR 1926.501(b)(14):     Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.    On November 13, 2012 during construction activities including, mortar joint tuck pointing of a window opening at a height of approximately 40 feet (4 stories) and the inside bottom edge of the window opening was less than 34 and ? inches above the working surface, the employer did not ensure employees were protected from fall hazards by using a fall protection system/device.

29 CFR 1910.134(c)(1):     A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:    On November 13, 2012, during construction activities including but not limited to masonry activities, the employer did not establish and implement a written respiratory program.  Employees are required to wear half-mask cartridge respirators during dry cutting, chipping, mixing, and other masonry activities.
