29 CFR 1910.178(l)(4)(iii):  An evaluation of each powered industrial truck operators performance was not conducted at least once every 3 years. (Construction reference 29 CFR 602(d)).  On or about September 13, 2012 an employee was operating a rough terrain, telescoping boom fork lift without the employer conducting an evaluation of the operators performance at least once every 3 years, exposing the employee to the hazards associated with operating a forklift.

29 CFR 1926.201(a):  Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers did not conform to Part VI of the Manual on Uniform Traffic Control Devices, (1988 Edition, Revision 3 or the Millennium Edition).  Manual on Uniform Traffic Control Devices, (1988 Edition, Revision 3) Paragraph 6D-2  Employees were not trained on how to work next to traffic in a way that minimizes their vulnerability to include; traffic control techniques, device usage, and placement.  On or about September 13, 2012 an employee was directing a delivery truck out of the construction site and onto the main street when the truck struck the forks of a rough terrain, telescoping boom fork lift that was parked. The forklift subsequently struck an employee passing between the fork lift and a vertical column. Employees guiding vehicles have not received traffic control training from the employer, exposing employees to the hazard of being struck by vehicles.
