29 CFR 1926.602(b)(3): The safety requirements, ratios, or limitations applicable to machines or attachment usage covered in Power Crane and Shovel Associations Standards No. 1 and No. 2 of 1968, and No. 3 of 1969, were not complied with: a) At the work site, on November 5, 2012, the employer failed to comply with Standard No. 3, Mobile Hydraulic Excavator Standards, Section 8.01 in that employees were not required to thoroughly study and understand all the instructions contained within the owner's manual prior to operating the Case 580M serial number JJG0808616 excavator. An employee operated the excavator outside of the cab.

29 CFR 1926.652(b): The slopes and configurations of sloping and benching systems were not in accordance with the requirement options of 29 CFR 1926.652(b)(1), (b)(2), (b)(3), or (b)(4): a) At the worksite, on or about November 6, 2012, all sides of an excavation, 7 feet deep, were not sloped and/or benched. Employees were exposed to cave-in hazards when pouring concrete and setting rebar inside the excavation.

29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement: a) At the worksite, on or about November 6, 2012, employees were pouring concrete and setting rebar inside the excavation. The vertical rebar inside the excavation was not equipped with caps, exposing employees to impalement hazards.
