29 CFR 1910.178(m)(6): A safe distance was not maintained from the edge of ramps or platforms while on any elevated dock, or platform or freight car: a.Site- Employees operating fork trucks are not protected from crushing hazards where the fork trucks are driven up the boat launch and there are no means of stopping the fork trucks from driving off the boat launch and falling into Lake Winnipesaukee. On or about November 6, 2012 an employee was exposed to a crushing hazard when the Liftall, model HTMS100D, fork truck they were operating drove off of the boat launch and fell into Lake Winnipesaukee.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service, or were placed in service if the examination showed conditions adversely affecting the safety of the vehicle: a.Site- Employees operating fork trucks were exposed to crushing hazards where the employer failed to ensure that fork trucks were inspected prior to being placed in service. On or about November 6, 2012 an employee was exposed to a crushing hazard when the Liftall, model HTMS100D, fork truck they were operating was not inspected before being placed into service and the brakes failed to engage when approaching the boat launch; the fork truck could not stop and was driven off the edge of the launch and fell into Lake Winnipesaukee.
