OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) in that employee(s) were exposed to the hazard of an unplanned collapse:   JOB SITE: 3949 Lindell Boulevard, Saint Louis, MO 63108, at this work site, the employer failed to provide an adequate engineering survey for the stairwell that was adjacent to the demolished building:   a) Engineering Survey, dated 9/26/2012, was to determine the structural integrity of all remaining units and if they may be refurbished and occupied.  b) engineering Survey, dated 9/26/2013, did not address the stairwell adjacent to the building that was destroyed by fire beyond use and was demolished.   One method of abatement to correct the apparent hazard, when indicated as advisable, any adjacent structure or improvement should also be similarly checked.  Prior to beginning work, all parties involved shall meet to establish a safe work program as required by American National Standards Institute (ANSI) A10.6-1990.

One method of abatement to correct the hazard is an inspection shall be made by a comptetent person as the work progresses to detect hazards resulting from weakened or deteriorated floor,wall, or loosened material.  NO worker shal lbe permited to work where such hazards exist until they are corrected by shoring, bracing, or other effective means as required by American National Standards Institute (ANSI) A10.6-1990.
