29 CFR 1926.451(g)(1):   Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level.   a) Front sidewalk of Prince Hotel, Braga Concrete LLC, 45 East Tioga Street, Tunkhannock, PA: Two (2) employees were working thirty (30) feet above a concrete sidewalk on two fabricated frame scaffolds bridged with an aluminum pickboard without any personal fall arrest systems or guardrail systems, observed on or about November 16, 2012.  In accordance with 29 CFR 1903.19(c) and (d), abatement certification and documentation is required for this violation.

29 CFR 1926.451(b)(1):   Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports.  a) Front sidewalk of Prince Hotel, Braga Concrete LLC, 45 East Tioga Street, Tunkhannock, PA: Two (2) employees were working thirty (30) feet above a concrete sidewalk on two fabricated frame scaffolds bridged with an aluminum pickboard. The platforms on the working levels were not fully planked or decked and were approximately sixteen (16) to twenty (20) inches wide, observed on or about November 16, 2012.  In accordance with 29 CFR 1903.19(c) and (d), abatement certification and documentation is required for this violation.

The cross braces were of such length as will automatically square and align vertical members so that the erected scaffold is always plumb, level, and square. All brace connections were not secured.  a) Front sidewalk of Prince Hotel, Braga Concrete LLC, 45 East Tioga Street, Tunkhannock, PA: Two (2) employees were working on scaffolds with frames not braced securely laterally and with brace connections not secured on the north sides of the West Scaffold and East Scaffold, observed on or about November 16, 2012. 29 CFR 1926.451(e)(1):   When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces should not, but were being used as a means of access.  a) Front sidewalk of Prince Hotel, Braga Concrete LLC, 45 East Tioga Street, Tunkhannock, PA: An employee used a crossbrace approximately thirteen (13) feet above a concrete sidewalk to access and exit the West Scaffold, observed on or about November 16, 2012.
