29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: The employer does not provide a copy of Appendix D. This violation was observed on or about November 14, 2012, on a newly constructed building insulation operation where employees were exposed to a physiological hazard when wearing a 3M particulate filtering facepiece respirators without providing Appendix D. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a develop and implement respiratory protection program in accordance with sections i and ii of this paragraph (c)(2) for employees who chose to wear respirators where respirator use is not required.
