29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use. a. At the site, an employee was operating a Terex all terrain forklift, model TH636C, serial number 035043 in a manner that was not designed by the manufacturer. The forklift was used to elevate two personnel in a work platform at a height greater than approximately 13 feet, thereby exposing employees to a fall hazard.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a. At the construction site located at 235 Edwards Road Circleville, Ohio, employees were working installing Tyvek on a residential apartment building with a 4 in 12 pitch, approximately 8 feet in height with no fall protection.
