Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards associated with piping pressurization. On or about 9/05/12, during fracking operations at the Amsouth #31 gas well the employer did not protect employees from the hazards associated with pressurized piping. Employee(s) were pressuring the pipline associated with the fracking operation without ensuring the in-line valves were open. The over pressurization caused the pipe to rupture. Employee(s) were injured by the high pressure release.
