29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D of 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: (Construction Reference 1926.103) a) The employer did not provide the information contained in Appendix D of 29 CFR 1910.134 (Information for Employees Using Respirators When Not Required Under the Standard) when it was determined that voluntary respirator use was permissible. This violation occurred on or about November 16, 2012 when employees were allowed to wear NIOSH-Approved N-95 filtering face-piece respirators while working on the fourth (4th) floor and had not been provided with the information contained in Appendix D.
