OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a tipover hazard: (a) Construction site: On or about November 15, 2012 and at times prior thereto, employees were exposed to tipover hazard, while installing new roofing materials from a platform mounted on a Gehl Dynalift Model 663 rough terrain forklift truck. The platform was approximately 20 feet wide and was positioned approximately 24 feet above the ground level below.
