29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: (a) On or about November 16, 2012, Reconstruction Experts, Inc., as the controlling contractor, did not protect workers of FYD Roofing (subcontractor) from fall hazards while they were conducting roofing activities on a roof in excess of six feet above the lower surface. (b) On or about November 16, 2012, Reconstruction Experts, Inc., as the controlling contractor, did not protect workers of Riverstar Construction (subcontractor) from fall hazards while they were conducting roofing activities on a roof in excess of six feet above the lower surface. Reconstruction Experts, Inc. was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13) or its equivalent which was contained in OSHA inspection 315019174, Citation 1, Item 2a issued April 25, 2011, with respect to a workplace located at 4702-4762 & 4721-4761 Rowell Point, Colorado Springs, CO. This citation became final order on May 6, 2011.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders' length allows, the ladder side rails did not extend at least 3 feet above the upper landing surface being accessed: (a) On or about November 16, 2012, Reconstruction Experts, Inc., as the controlling contractor, did not protect workers of FYD Roofing (subcontractor) from being exposed to fall hazards while using portable ladders that did not extend at least 3 feet above upper landing surface being accessed. (b) On or about November 16, 2012, Reconstruction Experts, Inc., as the controlling contractor, did not protect workers of Riverstar Construction (subcontractor) from being exposed to fall hazards while using portable ladders that did not extend at least 3 feet above upper landing surface being accessed. Reconstruction Experts, Inc. was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.1053(b)(1) or its equivalent which was contained in OSHA inspection , Citation 1, Item 3a issued April 4, 2011, with respect to a workplace located at 4602, 4622 and 4642 Rowell Point, Colorado Springs, CO.
