29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions: On or about 11/19/12, employees were exposed to a fall from approximately 19 feet high to the ground level below. Employees were wearing PFAS harnesses; however they were not required by the site foreman to tie off to anchor points.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: On or about 11/19/12, employees were exposed to a fall from approximately 19 feet high to the ground level below while performing roofing work as part of their normal work duties. Employees were wearing a harness of a PFAS but were not connected to a lifeline or lanyard.
