OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, in that an employee was exposed to a fall hazard:      a) Facility, Resale Store located at 1635-B South Braddock Avenue, Pittsburgh:  On or before 10/23/12, an employee was cleaning ventilation grills (1-3) located on the ceiling along the north wall of the building near the window and door section.  The employee was working from inside a wood box that was used as a work platform and elevated by a Kalmar AC forklift, Model 35AX, which did not have adequate guardrails and no means to securely attach the platform to the carriage or forks. The employee was exposed to a fall hazard of approximately 7 feet 9 inches.

29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck.    a) Facility, Resale Store located at 1635-B South Braddock Avenue, Pittsburgh: On or before 10/23/12, the employer did not provide training to the operator of the Kalmar AC, Model 35AX prior to operating the powered industrial truck.
