29 CFR 1910.178(o)(1):  The employer did not ensure that only stable or safely arranged loads were handled and that  caution was exercised when handling off-center loads which could not be centered.    (a)  R & S Steel, 3811 Joliet Street, Denver, CO 80239; On and before November 19, 2012, the exposing employer did not ensure that a two forklift tandem lift had its load stable and safely arranged.  Condition resulted in two 40' long, 8" x 8" square steel beams which were being loaded onto a flatbed truck falling and then stricking an employee resulting in his death.

29 CFR 1910.178(l)(3)(ii): Powered industrial truck operators did not receive training in workplace-related topics specific to the safe conduct of their vehicles:    (a) R & S Steel, 3811 Joliet Street, Denver, CO 80239; On and before November 19, 2012, the exposing employer failed to conduct a job safety analysis to determine the hazards associated with lifting, transporting, and loading of 40-foot long steel tube beams utilizing a tandem forklift protocol.  The composition of the loads handled by the forklifts consisted of bundeld and unsecured single steel beams.  The movement between the tandem forklifts, the configuration of the load, and the size and shape of the steel beams all affect the overall stability of the load being handled.  Employees were not adequately trained to recognize how each of these factors affects load stability and how to minimize these factors to achieve and maintain a stable load during truck operations.  This condition resulted in a fatality where a truck driver was struck by two steel beams that fell off the tynes of a forklift while loading a tractor trailer.      (b) R & S Steel, 3811 Joliet Street, Denver, CO 80239; On and before November 19, 2012, the exposing employer failed to develop and enforce a policy to ensure that all personnel are prevented from entering the fall shadow (potential struck-by zone) while materials are being loaded onto tracktor trailers.  Truck drivers are required to adjust wooden skids on the trailer prior to the steel beams being loaded by the forklifts.  This places the driver directly in the fall shadow of the beams loaded by the forklifts.  This condition resulted in a fatality where a truck driver was struck by two steel beams that fell off the tynes of a forklift while loading a tractor trailer.

29 CFR 1910.212(a)(3)(ii):  The point of operation of machines whose operation exposes an employee to injury were not guarded.     (a) R & S Steel, 3811 Joliet Street, Denver, CO 80239; On and before November 19, 2012, the exposing employer did not ensure that the point of operation of a HemSaw band saw, Serial Number 263301, Model Number WF130HM-DC, was adequately guarded against contact with the machines point of operation.  Condition exposed employees to laceration and amputation hazards as they operated the saw.     R & S STEEL WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1910.212(a)(3)(ii) WHICH WAS CONTAINED IN OSHA INSPECTION # 314662644 CITATION 1, ITEM 1, ISSUED ON MARCH 3, 2011, WITH RESPECT TO THE WORKPLACE LOCATED AT 3811 JOLIET STREET, DENVER, COLORADO, 80239. THE FINAL ORDER DATE FOR THE CITATION WAS ON MARCH 28, 2011.
