OSH ACT of 1970 Section (5)(a)(1): 29 CFR Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with being crushed or struck by falling objects: Warehouse: The commercial steel storage racks used to store pallets of masonry products such as tiles and the mezzanine levels used to store items such as foam forms and miscellaneous items were not maintained to prevent collapse of the racks. Deficiencies included, but were not limited to: a) Bottom portions of the racks were damaged in areas such as the columns for the two mezzanines and the free standing front center and back center racks. b) Columns of the front and back center racks that have removable shelves were not anchored to the floor. c) The supports for the two mezzanines and the front center and back center racks were rusted.
