29 CFR 1910.38(a): The employer did not establish a written emergency evacuation plan for employees expected to evacuate in the event of a fire or other emergency.  On or about November 19, 2012, employer did not have a written Emergency Action Plan for the evacuation of employees, indicating the directions employees are to take, when evacuating the building in case of a fire or emergency, exposing the employees to the hazard of coming in contact with fire.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees know what directions to take when evacuating the building in case of a fire or an emergency.

29 CFR 1910.157(e)(1): The employer shall be responsible for the inspection, maintenance and testing of all portable fire extinguishers in the workplace.  On or about November 19, 2012, employer had three Kidde portable fire extinguishers in the workplace, and all three fire extinguishers were discharged, exposing employees to the hazard of coming in contact with fire.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each portable fire extinguisher in the workplace is inspected, maintained and tested.

29 CFR 1910.213(c)(3): Hand-fed ripsaw(s) did not have non-kickback fingers or dogs so located as to oppose the thrust or tendency of the saw to pick up the material or to throw it back toward the operator.  On or about November 19, 2012, employees were using two Shop Fox table saw for ripping lumber and the non-kickback fingers or dogs were in a horizontal position instead of returning to the vertical position, exposing employees to the hazard of being struck by materials thrust or thrown back towards the operator.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that hand-fed ripsaws have the non-kickback fingers or dogs located in a position that will oppose the thrust or throw the material back towards the operator.

29 CFR 1910.303(b)(1)(iv): Electric equipment was not free from recognized hazards that were likely to cause serious physical harm to employees, such as damaged electrical insulation:  On or about November 19, 2012, employees were conducting sanding operations using an electric sander plugged into a 50 foot extension cord which had the insulation damaged and the conductors were protruding through the insulation, exposing employees to the hazard of an electrical shock.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that electrical equipment, and extension cords, are free inspected for damaged to the electrical insulation.

29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms or service rooms were not kept clean and orderly or in a sanitary condition.  On or about November 19, 2012, employees were ripping lumber for manufacturing rustic furniture and a large accumulation of scrap lumber was piling up on the floor next to the three miter saws, two Shop Fox table saws and one Shop Fox router, exposing the employees to the hazard of falls by tripping.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the shop floors are kept clean from debris around the machinery being used.
