29 CFR 1926.252(a): An enclosed chute of wood, or equivalent material, was not used where materials were dropped more than 20 feet to points lying outside the exterior walls of the building(s): On or about November 16, 2012, employees working at ground level were exposed to a struck-by hazard, while employees working above threw asphalt roof shingles off the roof and into a dump truck, located at ground level, approximately 35 feet below the roof's edge, without using a chute.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, warning line system and personal fall arrest system, or warning line system and safety monitoring system: On or about November 16, 2012, employees were working on the roof of a 4 story hotel, removing and replacing asphalt roof shingles, the employees were exposed to a fall hazard of approximately 35 feet to the concrete ground below, while not utilizing fall protection.
