29 CFR 1926.501(b)(10):     Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and fuardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.     (a)  On or about 11/16/12, on 3049 Ridge Road, at the KMart Store #3295, in Rochester, New York, employees performing roofing work, 15 feet above ground level; were not provided with conventional fall protection.    NO ABATEMENT CERTIFICATION REQUIRED          HARVEY STRASSNER CONTRACTING, LLC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 316089101, CITATION NO. 1 , ITEM NO. 2, AND WAS AFFIRMED AS A FINAL ORDER ON 01/30/12, WITH RESPECT TO A WORKPLACE LOCATED AT 911 RIDGE ROAD, WEBSTER, NEW YORK 14580.

29 CFR 1926.150(c)(1)(vi):     A fire extinguisher, rated not less than 10B, was not provided within 50 feet of wherever more than 5 gallons of flammable or combustible liquids or 5 pounds of flammable gas were being used on the jobsite:    (a)  On or about 11/16/12,  at the KMart store #3295, located on 3049 Ridge Road, in Rochester, New York, a fire extinguisher was not available for use, while more than 5 gallons of flammable liquids such as;  JM EPDM Bonding Cement and JM TPO Membrane Cleaner were used and stored on site with ignition sources (electrical tools).    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.404(b)(1)(iii)(C):     The employer did not ensure that each cord set, attachment cap, plug and receptacle of cord sets, and any equipment connected by cord and plug, except cord sets and receptacles which are fixed and not exposed to damage, were not visually inspected before each day's use for external defects, such as deformed or missing pins or insulation damage, and for indicationsof possible internal damage.        (a)  On or about 11/16/12, at the KMart Store #3295, located on 3049 Ridge Road, in Rochester, New York, an extension cord was in use with a missing ground pin.
