Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employment and a place of employment which are free from recognized fire and explosion hazards that are causing or are likely to cause death or serious physical harm to his employees: This violation most recently occurred on November 16, 2012, in the truck rack area; where: a. Employees, who were bottom filling a tanker trailer with category 2 flammable liquids, were exposed to fire and explosion hazards. b. Employees, who used compressed air to blend/agitate category 2 flammable liquids inside a tanker trailer, were exposed to fire and explosion hazards. Among other methods, feasible and acceptable means to abatement these hazards include, but are not limited to: a. Use a vapor handling system in accordance with the tanker trailer manufacturer's desiign specifications and applicable regulatory requirements. b. Use an insert gas when blending/agitating flammable liquids. Pursuant to 29 CFR 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to protect employees from fire and explosion hazards.
