29 CFR 1926.153(o): When damage to LP-Gas systems from vehicular traffic was a possibility, precautions against such damage were not taken: a) On or about 11/19/12, south and just west of the front of the one story building attached to the gable barn being constructed at Sleepy Hollow Lake, 13800 Siehl Road, Akron, NY: There was an unprotected 120 gal. propane tank in an open area, exposed to the possibility of being struck by cars, trucks, and a concrete truck in the area. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system: a) On or about 11/16/12, at the gable barn being constructed at Sleepy Hollow Lake, 13800 Siehl Road, Akron, NY: A ladder jack scaffold was erected with one support ladder on each side of the sloped roof of a one story building attached to the front side of the barn. An employee was on the 12 inch wide "pik" of the scaffold hanging siding, and was exposed to a fall of approx. 14 ft. to the lower roof below. The employee was not protected by a personal fall arrest system, nor was any other fall protection system being utilized. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity: a) On or about 11/16/12, at the gable barn being constructed at Sleepy Hollow Lake, 13800 Siehl Road, Akron, NY: A ladder jack scaffold was erected with one a support ladder on each side of the sloped roof of a one story building attached to the front side of a gable barn. An employee was on the 12 inch wide, 20 ft. long, aluminum "pik" of the scaffold hanging siding. It was clearly visible that the "pik" was not level. A competent person did not inspect this scaffold prior to use to detect this hazardous condition. NO ABATEMENT CERTIFICATION REQUIRED
