29 CFR 1926.1101(k)(2)(i): Before work subject to this standard was begun, building and facility owners did not determine the presence, location, and quantity of ACM and/or PACM at the work site pursuant to paragraph (k)(1) of this section: a.) 15 Prince Street, Rochester, NY - 2nd floor storage room - On or about 11/7/12, a plumber removed approximately 2 feet of asbestos-contining pipe insulation to repair a leaking pipe. Before work on asbestos-containing (ACM) or presumed asbestos-containing materials (PACM) was begun, the building and/or facility owner did not detrmine the presence, location, and quantity of ACM and/or PACM at the work site, as required. ABATEMENT CERTIFICATION RQUIRED

29 CFR 1926.1101(k)(2)(ii): The building and/or facility owner(s) did not notify prospective employers, tenants, employees of the owner, and all employers of employees who would be performing work within adjacent areas of the presence, location, and quantity of asbestos containing material or presumed asbestos containing material, at the work sites in their buildings and facilities in writing, or a personal communication between the owner and the person to whom notification must be given or their authorized representatives: a.) 15 Prince Street, Rochester, NY - on or about 11/7/12, a plumber performed repairs on a radiant heat system pipes, requiring the plumber to remove approximately 2 feet of asbestos-contining pipe insulation (15% amosite and chrysotile asbestos). The building owner did not notify tenants, contractors employees of the owner and all employee who might be performing work of the presence, location and quantity of asbestos-containing materials. ABATEMENT CERTIFICATION REQUIRED
