29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. (a) Jobsite: On or about November 14, 2012, employees were accessing the tubular welded frame scaffolding by climbing the uprights and the crossbraces.

29 CFR 1926.451(g)(2): The employer did not provide fall protection for employees erecting or dismantling supported scaffolds: (a) Jobsite: On or about November 14, 2012, employees were erecting a tubular welded frame scaffold and they were not protected from falling. The employees were erecting the scaffolding next to a house that was under construction.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) Jobsite: On or about November 14, 2012, an employee was working from a porch roof and he was not protected from falling. The fall hazard was 11 feet to the ground. The pitch on the roof was 4 in 12.
