29 CFR 1926.1101(k)(5)(ii)(A) The employer did not demonstrate that PACM does not contain more than 1 percent asbestos by the following: Having a completed inspection conducted pursuant to the requirements of AHERA (40 CFR Part 763, Subpart E) which demonstrates that the material is not ACM. On November 21, 2012, the employer did not have a complete inspection conducted pursuant to the 40 CFR Part 763, Subpart E AHERA requirements to demonstrate the Presumed Asbestos Containing Material (PACM) is not Asbestos Containing Material (ACM). Several different homogeneous areas were identified throughout the building and, at minimum, three random bulk samples were not collected from each homogeneous area that is less than 1000 square feet. In addition, the employer did have a completed inspection conducted pursuant to the requirements of 40 CFR 763, Subpart E which requires a homogeneous area to be determined to contain asbestos on the finding that the results of at least one sample collected from that area shows asbestos present in an amount greater than 1 percent. As a result, employees started demolition activities with ACM still inside of the building, exposing themselves to airborne asbestos fibers.

29 CFR 1926.1101(l)(4)(ii) Waste and debris and accompanying dust in an area containing accessible thermal system insulation or surfacing ACM/PACM or visibly deteriorated ACM was not promptly cleaned up and disposed of in leak tight containers. On November 21, 2012, at 5355 El Paso Drive, the employer did not promptly clean up and dispose of asbestos containing materials. Employees had started demolition of the building with ACM still located in the building. Demolition activities were stopped midway through with asbestos containing materials found in open air, debris piles located in the northwest area of the building.
