OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) On November 23, 2012, and times prior thereto, at the Findlay Gin Company worksite in Vienna, GA, the employer failed to ensure that a forklift used daily was equipped with a seatbelt and that operators engaged it, exposing employees to struck-by and entrapment hazards following a tipover or collision. ABATEMENT CERTIFICATION IS NOT REQUIRED.

29 CFR 1928.57(a)(6)(iii): Employees were not trained to stop engine, disconnect the power source, and wait for all machine movement to stop before servicing, adjusting, cleaning, or unclogging the equipment, except where the machine must be running to be properly serviced or maintained, in which case the employer shall instruct employees as to all steps and procedures which are necessary to safely service or maintain the equipment: a) On November 23, 2012, and times prior thereto, at the Findlay Gin Company worksite in Vienna, GA, the employer failed to train affected employees on safe operating instructions of cotton-gin equipment at the time of initial assignment and at least annually thereafter, to include the stopping of the motor, disconnecting of the power source(s), and waiting for all machinery to stop movement before unclogging or cleaning, exposing employees to hazards not limited to entrapment and avulsion. ABATEMENT CERTIFICATION AND DOCUMENTATION IS REQUIRED.
