29 CFR 1910.146(c)(2): In a workplace containing permit spaces, the employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces: a) Eighth Floor, HPAC 12 and 13 - The host employer did not inform a subcontractor's employees working inside of HVAC ducts by the posting of danger signs or other equally effective means, that their work area was, in fact, a permit space, on or about 11/25/12. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.146(c)(8)(i): When an employer arranged to have employees of another employer (contractor) perform work that involved permit space entry, the host employer did not inform the contractor that the workplace contained permit spaces and that permit space entry is allowed only through compliance with a permit space program: a) Eighth Floor, HPAC 12 and 13 - The host employer, who contracted with a contractor to relining the insulation of duct work, did not inform them that the workplace contained permit spaces and that entry of those spaces would not be allowed until their subcontractor complied with all program requirements in this section, on or about 11/25/12. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.
