29 CFR 1910.107(b)(5)(iv):     Space within the spray booth on the downstream and upstream sides of filters shall be protected with approved automatic sprinklers.    a. On or about November 26, 2012, in the fabrication shop,employees were required to use a spray booth that was not equipped with a sprinkler system.  Employees were thereby exposed to the hazards associated with fire.

29 CFR 1910.107(b)(5)(i):     The spraying operations except electrostatic spraying operations shall be so designed, installed and maintained that the average air velocity over the open face of the booth (or booth cross section during spraying operations) shall be not less than 100 linear feet per minute. Electrostatic spraying operations may be conducted with an air velocity over the open face of the booth of not less than 60 linear feet per minute, or more, depending on the volume of the finishing material being applied and its flammability and explosion characteristics. Visible gauges or audible alarm or pressure activated devices shall be installed to indicate or insure that the required air velocity is maintained. Filter rolls shall be inspected to insure proper replacement of filter media.    a. On or about November 26, 2012, in the painting area, employees were required to use a spray booth weekly. The spray booth did not have a manometer to indicate adeqaute air flow for use with flammable paint.

29 CFR 1910.178(q)(1):     Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel.    a. On or about November 26, 2012, in the facility, employees operated a propane powered forklift truck that emitted carbon monoxide in excess of the recommended level of 1%:    Nissan Forklift  emitted carbon monoxide levels between 2.2 % - 5.0%     Inhalation of excessive levels of carbon monoxide can result in headaches, nausea and chemical anoxia.

29 CFR 1910.178(q)(7):     Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.    a. On or about November 26, 2012, in the facility, employees were required to use powered industrial vehicles on a daily basis. The powered industrial vehicles were not regularly inspected prior to use to verify their working condition.

29 CFR 1910.1200(h)(1):     Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets.    a. On or about November 26, 2012, in the painting area, a new employee was not trained,  in the hazards associated with chemicals such as, but not limited to xylene and naptha.

29 CFR 1910.134(c)(2)(ii): In addition, the employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user. Exception: Employers are not required to include in a written respiratory protection program those employees whose only use of respirators involves the voluntary use of filtering facepieces (dust masks).     a. On or about September 22, 2011, in the battery charging areas, employees required to work connect forklift batteries were not provided with suitable facilities for quick drenching or flushing of eyes.
