29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: a) At the worksite, 11810 Fairmont Parkway, La Porte Texas, on November 26, 2012, two employees were using the boring machine inside the excavation to bore underneath the sidewalk. The spoil piles were located adjacent to the sidewalls. This condition exposed employees to stuck-by hazards.

29 CFR 1926.652(b): The slopes and configurations of sloping and benching systems were not in accordance with the requirement options of 29 CFR 1926.652(b)(1), (b)(2), (b)(3), or (b)(4): a) At the worksite, at 11819 Farmont Parkway, La Porte, TX, on November 26, an employee and the foreman were conducting boring operations inside an excavation which measured approximately 14 feet deep, 17 feet wide, and 19 feet long. The excavation was improperly benched with 3 benches measuring approimxately 3-4 feet tall, and 1-2 feet wide. This condition exposed employees to cave-in hazards.

29 CFR 1926.1053(b)(1): Because of the portable ladder's length, the ladder side rails did not extend to at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access and the ladder was not secured at its top to a rigid structure: a) At the worksite 11810 Farmont Parkway, La Porte, Texas, on November 26, 2012, an employee and the foreman were conducting boring operations inside the excavation which measured approximately 14 feet deep. The ladder used for egress was not long enough to extend at least 3 feet above the landing surface.
