OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to being struck by. Location: 233 Broadway New York, NY (Parking garage) On or about 11/26/12 a) At the parking facility; Employees were exposed to struck-by, caught-between and/or crushing hazards, due to unintended movement of vehicles. As an employee was walking from one section of the garage to another section, a vehicle that was parked on an elevated platform moved/rolled forward, fell and crushed the employee. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: To follow the car lift manufacturers Operations and Maintenance Manual for the Rotary VSS7 (000-100 Series), Page 3, "Safety Instructions". 1. Always shut off engine and engage parking gear and brake before exiting the vehicle.
