29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): (a)Mason Development, Inc. @ 2374 W. 33rd Ave., Denver, CO 80204: On and before November 9th, 2012, the employer did not ensure that competent person inspections were conducted to ensure employees were protected from falling from elevation, and protected from over-head exposures while conducting framing operations on a multi-family residnce under construction. The conditions exposed employees to fall hazards of approximately 20 feet and struck-by hazards resulting from employees working at lower levels while employees were sheathing. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, personal fall arrest system, or other approved alternative fall protection system: (a) Mason Developments, Inc. @ 2374 W. 33rd Ave., Denver, CO 80204: On and before November 11th, 2012, the controlling employer did not ensure subcontractor framing employees were protected from injury, in that employees conducting sheathing operations near the edge of the second story balcony and roof were utilizing a fall protection system. This condition exposed the employee to a falls of approximately 10 feet and 20 feet.
