29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:    a)  Harris Airport off Rte. 149, Fort Ann, NY - On or about 11/23/12 - Employees on jobsite accessing the roofing work via an aerial lift were not wearing a body belt/harness with a lanyard and were exposed to an approximately 24 foot fall hazard.    Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.    Harris Airport off Rte. 149, Fort Ann, NY - On or about 11/23/12 - Employee and a subcontractor not wearing fall protection equipment (body belt/harness with lanyard) and exposed to a fall hazard of approximately 24 feet were not trained in hazards associated with working from aerial lifts.
