29 CFR 1910.26(c)(1): Good safe practices in the use and care of ladder equipment were not employed by the users to get maximum serviceability, safety, and to eliminate unnecessary damage of equipment: a) in that 8-foot A-Frame step ladders were being leaned against the truck trailer and used in a closed position to load branches into the truck. This practice is not in accordance with the manufacturers instructions and creates a fall hazard for the user(s).

29 CFR 1904.39(a): The employer did not orally report the death of an employee or the in-patient hospitalization of three or more employees because of a work-related incident: a) for the company doing business as Suncoast Environmental Services. On or about 11/20/2012 an employee experienced an accident and subsequently died on 11/21/12. OSHA was not notified of the death until 11/27/12.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: a) in that employees were not trained on how to use and read the material safety data sheets for products such as gasoline which was used in equipment such as the saws, trimmers, and edgers.
