29 CFR 1926.62(c)(1):     The employer did not ensure that no employees were exposed to lead at concentrations greater than fifty micrograms per cubic meter of air (50 ug/m3) averaged over an 8-hour period:    (a)Coopers Creek Bridge:  An employee was plasma arc cutting structural bridge beams and was exposed to 130.0 micrograms per cubic meter of airborne lead for an 8-hour time weighted average for the 280 minute sampling period.  The employer has not ensured that employees were not exposed to lead concentrations above the permissible exposure limit of 50.0 micrograms per cubic meter, as determined on December 20, 2012. 29 CFR 1926.62(d)(4)(ii):     Where the employer had previously monitored for lead exposure, and the data was not obtained within the past 12 months during work operations conducted under workplace conditions closely resembling the processes, type of material, control methods, work practices and environmental conditions used and prevailing in the employer's current operations, the employer relied on such monitoring results to satisfy the requirements of 29 CFR 1926.62(d)(4)(i):      (a)Coopers Creek Bridge:  An employee was plasma arc cutting structural bridge beams and was exposed to 130.0 micrograms per cubic meter of airborne lead for an 8-hour time weighted average for the 280 minute sampling period.  The employer was relying on previous employee exposure monitoring that was conducted beyond the past 12 months.  The employer's previous monitoring used for employee exposure was conducted in 2009, as determined on December 20, 2012.    Abatement Certification Required for this Item.

29 CFR 1910.134(g)(1)(i)(A):     Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function (Construction Reference 29 CFR 1926.103):    (a)Coopers Creek Bridge:  Employees were plasma arc cutting structural bridge beams and were required by the employer and due to exposure to airborne lead to wear 3M half masked air purifying respirators.  The employer did not ensure that the employees were clean shaven.  The employees had facial hair that came between the face and the sealing surface of the respirator, as determined on November 28, 2012.

29 CFR 1926.501(b)(1):     Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    (a)Coopers Creek Bridge, South End:  Employees were exposed to a fall hazard of approximately 16 feet from the structural steel bridge beams.  Employees had to walk 52 inches on the structural steel beams before they could attach to the horizontal life line.  There were openings of 24 inches on either side of the structural steel beam, as observed on November 28, 2012.
