Construction Reference: 1926.59  NOTE: The requirements applicable to construction work under this section are identical to those set forth at � 1910.1200 of this chapter.    29 CFR 1910.1200(h)(1):     Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:    a) On or about 27 November 2012, the employer did not provide the employee(s) with training regarding the health hazards of crystalline silica.   Road grinding workers were exposed to hazardous airborne particulate matter containing crystalline silica (up to 5%) while cutting and/or grinding curb-side concrete.

29 CFR 1926.102(a)(1):     Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.    a) On or about 27 November 2012, the employer did not ensure that workers grinding and/or cutting curbside concrete used eye protection (safety glasses) to protect them against flying particles [containing up to 5% crystalline silica].  Six workers were exposed to a plume of dust generated from during cutting of curbside concrete using a STIHL TS420 saw and or/grinding asphalt/concrete with a Dynapac Compact Planer Tractor.  None of them was observed wearing safety glasses.

29 CFR 1926.102(a)(3):     The vision of employees requiring use of corrective lenses in spectacles was not protected by goggles or spectacles of one of the types listed in paragraphs (i) through (iii) of this section.    a) On or about 27 November 2012, the employer did not provide worker(s) that required vision correction glasses with eye protection (safety glasses) to protect them against flying particles.  An employee, assisting the worker(s) dry-cutting curbside concrete with a saw, needed vision correction spectacles.  He was exposed to flying particles [containing up to 5% crystalline silica] from the curbside job and was not provided with safety goggles that fit over his vision correction spectacles.
