OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard: On or about November 12, 2012 Location: 42 Winding Ridge Road, White Plains, NY 10603: a) An employee was limbing and bucking a tree which had fallen onto sloping ground on top of a 10 foot 2 inch high retaining wall. A cut section rolled toward the employee causing him jump off the wall to avoid being struck causing injury to the employees ankle. Abatement Note: Among other methods, feasible and acceptable methods to correct the hazard are: (1) Follow the limbing and bucking proceedures in American National Standard Institue (ANSI) standard Z133.1-2006 Section 8.7.3 stating the perferred working position is on the uphill side of the work. (2) Ensure that all employees are trained in the recognition of safety and health hazards associated with the cutting activities.
